Terms of Service — Working Draft
Effective Date: [INSERT DATE] | Last Updated: [INSERT DATE]
These Terms of Service ("Terms") govern your access to and use of Qure's website, accounts, medical identification services and related products, including Qure bracelets. By using Qure, you agree to these Terms. If you do not agree, do not use the service.
1. About Qure
Qure provides a medical identification service that connects a physical bracelet containing an engraved QR code to an online medical profile. When the QR code is scanned, the linked medical profile may be displayed through the Qure website and the designated emergency contact may be notified of the scan and associated location.
2. Eligibility and responsibility
You must provide accurate information and use Qure only for lawful purposes. Where a profile belongs to a child or another person who cannot legally manage their own account, the parent, legal guardian or other appropriately authorized person is responsible for creating and managing the profile.
3. Your medical information
You are responsible for the accuracy, completeness and currency of the medical information you add to Qure. Qure does not independently verify that information. You should update your profile whenever relevant medical information changes.
4. Medical and emergency disclaimer
Qure is a medical identification and information-access tool. It does not provide medical advice, diagnosis, treatment, monitoring or emergency medical services. Qure does not replace a doctor, hospital, ambulance service, official medical record or professional emergency response. The availability or accuracy of information accessed through Qure should not be treated as a guarantee of a particular medical outcome.
5. Emergency scan feature
When a Qure profile is scanned, Qure is designed to notify the designated emergency contact and provide the location associated with the scan. Location accuracy may depend on the scanner's device, browser, network and available location services. Qure cannot guarantee that a notification will always be delivered immediately or that a location will always be exact.
6. Bracelet use
The Qure bracelet should be worn and used according to any care instructions provided with the product. The bracelet is waterproof and reusable as described by Qure. If it is lost, damaged or no longer usable, contact Qure Support regarding replacement.
7. Acceptable use
- Do not use Qure to impersonate another person.
- Do not intentionally enter false medical information for the purpose of misleading someone.
- Do not attempt to gain unauthorized access to another person's account or profile.
- Do not interfere with the Qure website, QR system or security controls.
- Do not use Qure for unlawful, abusive or fraudulent purposes.
8. Orders, payments and replacements
The product page and applicable checkout terms will state the current price, payment methods, delivery information, cancellation rules, returns, refunds and replacement fees. Where these details change, Qure may update them without changing the core Terms.
9. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for notifying Qure if you believe your account has been compromised. Do not share account credentials in a way that could allow unauthorized access to your medical information.
10. Intellectual property
Qure and its licensors retain rights in the Qure name, logo, website, software, designs, content, systems and other intellectual property except where expressly stated otherwise. You may not copy, modify, distribute or exploit Qure intellectual property without permission.
11. Privacy
Qure's collection and use of personal and medical information is described in the Privacy Policy. By using Qure, you acknowledge that information will be handled according to that policy.
12. Third-party services
Qure may rely on third-party services for hosting, infrastructure, communications, payments, analytics, security and other operational functions. Those providers may have their own terms and privacy practices.
13. Service availability
Qure aims to keep its website and services available and reliable but cannot guarantee uninterrupted access. Maintenance, updates, network failures, device limitations or events outside Qure's reasonable control may affect availability.
14. Suspension and termination
Qure may suspend or terminate access where reasonably necessary to protect users, security, the service, or comply with law, including in cases of fraud, abuse or serious violations of these Terms.
15. Limitation of liability
To the maximum extent permitted by applicable law, Qure should not be responsible for indirect, incidental, special or consequential losses arising from use of the service, including losses resulting from inaccurate user-provided medical information, inability to access the service, delayed notifications, inaccurate location information, or reliance on Qure as a substitute for professional medical care. The final clause must be drafted and approved by legal counsel under the applicable law.
16. Indemnification
Where legally appropriate, users may be responsible for claims or losses arising from their unlawful use of Qure, violation of these Terms, or misuse of another person's information. Final wording should be reviewed by counsel.
17. Governing law and disputes
These Terms should identify the governing law and courts or dispute-resolution mechanism applicable to Qure. [LEGAL TEAM TO INSERT JURISDICTION AND DISPUTE PROCESS.]
18. Changes to these Terms
Qure may update these Terms as the service develops. Material changes should be communicated through an appropriate notice, and the "Last Updated" date should be changed.
